(a) The grant of patent rights must comply with 2 CFR 200.315 and 2 CFR 200.448. Unless otherwise provided by law, NFs are also subject to the Bayh-Dole Act, Pub. L. No. 96-517, as amended, codified as 35 U.S.C§ 200 et seq. All SNSFs are subject to the specific requirements relating to the development, notification and disposition of rights to inventions and patents resulting from financial support to 37 C.F.R. Part 401 and the standard patent clause in 37 C.F.R. § 401.14. (b) Any agreement granted by the OFCE to a small enterprise, non-profit organization or university to be carried out in the United States, its property or Puerto Rico for the purpose of carrying out experiments, development or research shall include the provision relating to patents.
